Is this a after market cartridge?

I don't think it is after-market - it comes in original HP packaging and appears to me to be an original HP part.

is this new oem toner cartridge?

Yes, it is OEM. Been using them in an HP Laserjet 4250 for years without a problem. It's a great printer and I won't risk using third party toners. Also cheaper than local office stores.
