Simple answer is No.  The computer comes with windows 8 but windows 8.1 is free to download from the app store.

Does this unit qualify for a free upgrade to Windows 10?

Yes it will.  It is my understanding, any fully updated Windows 7 or Windows 8.1 is eligible for the upgrade.  Now, not sure if Windows 8 is or not, but that has a free upgrade to 8.1.  I tried to update another machine, and it would not let me update until I installed all, I mean ALL Windows 7 updates.

if there is a touch screen can you still use the cursor?

Perhaps you are asking if you can control the cursor with a mouse instead of the touch screen. The answer to that question is "yes." I just tried it. You just plug the mouse in and "voila!" it works.
