Can I still upgrade to windows 10 for free?

You can upgrade your windows licence to 10 during the initial setup of the device, and windows offers the upgrade in the notification area, even if you decided not to upgrade at setup.

Even if you decide to factory reset the device, you still receive the same upgrade opportunities.

I know that the offers persist because I setup with 8.1 at the first. I used it for a day, then decided to upgrade to 10. I then mis-configured my 10 installation, and decided to do a factory reset. I was worried, that I would not receive the offer to upgrade again. But they were available at setup, and I presume, would have been available in the windows 8.1 notification area.

Question 2

Does this computer overheat fast?Cause my current pc does and i wouldnt want this happening to me again since i like working with my laptop on my lap.

I wouldn't say "Overheat" but this laptop can get hot really fast if you're gaming or doing something that pushes the CPU.  If working on your lap means doing lite applications like spreadsheets, emails or Word docs, then it should be okay.  Compared to other laptops, this one does well.

Is this locked at 49 hertz refresh rate....What kind of FPS can I expect gaming in 1080p?

The monitor refresh rate is at 60hz and the fps depend on the type of game your playing. For example playing League of Legends will allowed you to play at max setting with over 100 fps at 1080 but playing a game like GTA V at max  setting will get you lower fps. I'm not sure how low but don't expect anything over 55 or 60 fps.

Question 4

Does this laptop come with a lot of preloaded software on top of Windows 8.1? Things like ACER branded performance software, virus protection, etc? Or does it have a brand new FRESH installation of Windows 8.1?

As with almost any branded laptop, this computer came with lots of software I felt was "unnecessary", including Acer branded update tools, some third party stuff, and some AV program.  I spent the first couple of hours after I turned it on uninstalling the things I didn't want.  However, I have to say that it wasn't as bad as some other computers I've purchased in the past, and that this machine is AWESOME otherwise.  I'm quite happy with the purchase.

What 4k panel is this? Also is the screen capped at any fps? The lenovo y50 4k was capped at 48 hz and I want to make sure this one is not.
