Since we can't run Windows 10 due to our corporate policy, this coming with Windows 8.1 Professional is good.

Do these Microsoft surface pro 3 refurbish  units come with charger and pen?  Are they restored to excellent condition or might they have marks and scratches on them?

Mine came with pen and charger, packaged brand new as if from the factory. All the hardware and battery tabs that you have to remove on new products were all replaced.

Does this unit come with Microsoft Office?

Not as such, at least not free anyway.It is pre-installed you can try it for free, but to use it past the trial period, you must enter a product key to activate! That is for Office 365.

If I buy this right now, will it be eligible for the Windows 10 upgrade? This question has only been "half-answered" and I'm not convinced since it's a refurb..

No, the free upgrade window for Windows 10 is past.  That goes for any machine you buy unless it comes with Windows 10.

been thinking about getting one of these for a while now. but have one question. has the cpu throttling issues that has been reported with these been addressed yet? basically want to use photoshop cs6 and illustrator cs6 on it without it slowing down to a crawl.

I can't speak specifically for PS cs6 or Illustrator cs6. However, as a game developer I regularly use GIMP and Unity3D with this device. I haven't even noticed any slowdown when using those applications and the only difference I see is that the fan will crank into high gear. Also, to give an indicator of what this machine is capable of, I have ran several 3D games on it, some of them running at high graphics. I find the performance to be very impressive!

Will this refurb be eligible for the Windows 10 upgrade? I see this question has already been asked, but you haven't answered yet. I don't want to buy this until I know for sure that it will come with the upgrade.

I would recommend the Type Cover for SurfacePro 4 for the SurfacePro3.  The cover has been improved and it works well.  That's what I bought.

has the throttle issues reported on these been addressed yet? 
main reason why I haven't gotten one yet. don't want it coming to a crawl while running photoshop with more than a couple layers. I do graphic design  and photo restoration work so those are the types of work i'll be doing with it.

Apparently not.  I've had it come to a stop when just trying to convert a webpage to a PDF.
