We received ours new, in a sealed retail package. The build quality is quite solid. I am not familiar with Nintendo's lawsuit with Nyko, so I can not answer that part of your question. However, the item 'does' look exactly as it does in the photos. Our daughter uses this Wireless Nyko Nunchuk to play Animal Crossing on the Wii without any issues - a game that is notorious for rejecting anything wireless. we would not hesitate to buy another.
