Battery life? Has the batteries been replaced during the refurbishing process? If not what is the minimum battery life I can expect.

This is not a question that can be answered because it totally depends on how you use it. If you use it continually, say, for 6-7 hours per day, you can probably get no more than 4-5 hours out of it. On the other hand, if you are using it intermittently over the course of a day, you might expect to go all day without a recharge. I routinely put mine on charge overnight, and since I don't use it all day every day, I never run out of battery power.

I have had Surface Pros for several years and have never had to replace the battery.

Surface Pen, Included in Price?

No it doesn't include the pen. And the pen is very hard to come by.

Question 3

Since this is a refurbished item and comes with Windows 8.1 can I do a free upgrade to Windows 10 on this?

The refurbished status has no impact on the free upgrade. So long as you upgrade by the deadline in October,  it shouldn't be a problem.

Question 4

Can you change the screen resolution to 1024x768 & maintain aspect ratio (Panel Fit to all 4 corners)?

I am not sure why you would want to. Now if you're planning on plugging it Into another monitor then the resolution with go down to the native resolution of the monitor and you will be able to make it full screen on that monitor. This is an excellent computer. I just sold mine and got the iPad Pro and regret it!!!

Is this item a manufacturer-refurbished product, or refurbished by the seller (or third-party)? Also, does this come with the surface pen, or is the pen sold separately?

Look at the cost of the one year replacement plan: $50 for a $260 tablet.  That means they expect to replace one tablet for every five sold.  Not an endorsement of quality.  Definitely third party.
