compatible with windows 8.1?

Yes, according to Microsoft this product is Windows 8.1, but NOT Windows RT 8.1.

According the instructions on this reply page, I cannot put a link to the compatibility center.  if you do a search for "windows compatibility center" it will take you to a page where you can put in the manufacture model number "USR5638" and you can verify.

Question 2

Will work with windows 10?

In order for this Faxmodem to work with Win 10 you would have to contact the manufacturer and see if they have a driver for win 10. I used this item with Server 2003 and it worked ok. There is no demand for faxmodems any more so the manufacture is not going to spend on drivers.

Question 3

Is this modem compatible with Windows Server 2008r2 64 bit ?

The USR website says that it is. they provide a 64 bit driver for it and list as being compatible with 2008.

Question 4

can this modem originate a 56k handshake, or only recieve one?  That is to say, if i use this modem to connect to another moem, will it be at 56k or 3350?

I cannot give you the correct definative answer.  However, this MODEM will negotiate with it's counterpart and negotiate the highest rate possible between the two endpoints.
