The iPad Air in question is indeed a brand new, unopened device. New Egg does sell refurbished and open box items, but those will be advertised as such. This is also the latest model of the ipad as well.

Can I replace the battery if it becomes weak after multiple charging?

iPad wasn't designed to be taken apart by consumer. Battery replacement can only be done by Apple.

I honestly don't know the answer to your question. I would consider buying the higher memory device if you have any doubt. 
I know my usage patterns and 16Gb was good for me. I figured buying the 32Gb model would have been somewhat of a waste as I probably wouldn't have filled that much memory by the time I was looking to trade up.

It should automatically scan for updates and prompt you to update to iOS8. This should easily be done if you just purchased the iPad and don't have too many apps and downloads on it yet. I've had mine for about a year and have a decent amount of stuff on it. I haven't been able to update to iOS8 yet because it requires 7gb of space and I only have 4gb available. I will need to move some stuff around in order to update.

not sure of model of ipad .  do all ipads have rechargeable batteries in them?   bought new wire but ipad says it is not charging

If the charger is not a charger for the Ipad, it may not charge. I purchased after market chargers for Apple and have found not all of them will charge the Ipad.
I have since only purchased Apple Brand cables and chargers.
