will this work in a Tivo 3 or do I need the AV version?

The version of desktop drive does not matter when it comes to what will work. Any of them will work since you will be loading the TIVO os on it. What you should be looking for is drives that run about 5400 so they stay cooler and go with the NAS drives which are designed for continuous operation.

Is this drive new or used?

These are used. I can tell by the dust in the connector area. Also I did not received WD Blue drives as pictured.
